Sos Services Policy


SOS SERVICES POLICY

 

Medikoe shall, through the Medikoe mobile application (the “Mobile Application”), offer SOS Services (as defined in the Terms of Use). None of the SOS Services are intended as a substitute for contacting appropriate emergency care personnel in the event of an emergency. Users are requested to first contact a hospital/ambulance prior to availing any of the SOS Services offered.

All Users hereby accept and agree that they shall be availing the SOS Services at their sole option and risk.

This SOS Service Policy (the “Policy) shall govern the use of the SOS Services by Users. This Policy shall be in addition to the Terms of Use, Privacy Policy and other policies implemented by Medikoe from time to time.

The provisions of the Terms of Use and other Website policies implemented from time to time are incorporated herein by way of specific reference. All capitalised terms shall have the same meaning attributed to it in the Terms of Use.

Medikoe shall not be liable in any manner in the event of any failure to respond on the part of any emergency care provider or in the event of any negligence or improper rendering of services by the emergency service provider. Neither shall Medikoe be liable for any loss, damages or injury (including death) that may be caused to any user availing the SOS Services.

Users hereby accept and agree that none of the SOS Services are offered directly by Medikoe and that Medikoe is a platform that helps Users to connect with Practitioners listed with it. Medikoe may also provide additional Services offered by Practitioners and health care providers. Users further accept and agree that Medikoe is offering the SOS Services ‘as is’ directly from its service partners and without any representations or warranties.

The SOS Services provided by Medikoe are intended for all Users specifically elderly Users, accident victims and other Users who are in need of emergency services but are not aware of the closes hospital, pharmacy or emergency care centre.

Users may use the emergency services through the Mobile Application to alert five people, already registered by such User, of his/her emergency. Users shall ensure that their location services are turned on and is functional in order to effectively avail the SOS Services.

The SOS Services shall comprise of the following:

  1. Ambulance Services;
  2. Pharmacy Services;
  3. Blood Bank Services;
  4. Home Care Services;
  5. Such other emergency services as may be offered by Medikoe through the Mobile Application from time to time

The SOS Services are paid Services and Users shall be required to make necessary payments after availing the same.

  1. Ambulance Services

Users may through the SOS Services offered by Medikoe, request for an Ambulance in the event of an emergency. Medikoe makes no representations or warranties that the Ambulance shall arrive within the prescribed time. Medikoe shall not be liable for any delays in the arrival of the Ambulance for any reason. Users are requested to contact the nearest ambulance or emergency care provider in the event of an emergency prior to availing the SOS Services.

 

  1. Pharmacy Services

Medikoe shall also offer Pharmacy Services to deliver medication in the event of an emergency. Such services shall be offered by Medikoe by partnering with pharmacies and pharmacists within the Territory. The delivery of any medication requested for by the User shall depend upon a variety of reasons including but not limited to the User’s location and traffic conditions. Hence Medikoe makes no representations or warranties that the medication shall be delivered in time.

 

  1. Blood Bank Services

Medikoe may also provide Blood Bank Services in the event of an emergency. Medikoe shall partner with blood banks and hospitals within the Territory to provide blood to Users. Medikoe makes no representations or warranties regarding the blood group of the blood provided or regarding the quality of the blood provided. Neither does Medikoe guarantee that the blood shall be provided to the User in time. Users shall be required to state their requirements clearly at the time of requesting for the blood. Users may also be required to comply with any hospital or blood bank policies including but not limited to replacing the blood used.

 

  1. Home Care Services

Medikoe shall provide users with home care services in collaboration with hospitals, nursing homes and palliative care centres located within the Territory. A home nurse shall be provided to the User who shall assist or participate in providing care for the User within the User’s home. Medikoe makes no representations or warranties regarding the home nurse or pertaining to the home nurse’s skills and qualifications. Under no circumstances shall Medikoe be liable for any loss, damages or injury (including death) caused to any User due to the acts or omissions of the home nurse.

Under no circumstances shall Medikoe be liable for any loss, damages, injury (including death), costs, claims, suits or actions arising due to any issues with the SOS Services or with any Practitioner or any of Medikoe’s service partners. The same shall be sole liability of the Practitioner, Pharmacy or health care provider offering its Services through Medikoe.

Users shall ensure that their use of the SOS Services is only on the occurrence of an emergency. Users shall not use the SOS Services for any purpose that is or may be construed as unlawful or against public morality or in violation of any provisions contained herein or any other policy implemented by Medikoe from time to time, including but not limited to the Terms of Use.

Users shall be solely responsible for any loss, damages, costs, claims, suits or actions arising due to the use of the SOS Services by the User.

Users shall indemnify and hold Medikoe harmless from any and all loss, damages, costs, suits or actions arising due to the User’s acts or omissions.

Medikoe makes no representations or warranties, of any manner, regarding the merchantability, fitness, accuracy, compatibility of the SOS Services and the same are offered ‘as is’ directly from Medikoe’s service partners. Neither does Medikoe represent or warrant that the SOS Services shall be continuous, uninterrupted, error free or suits the requirements of the User availing it.

Medikoe hereby excludes any and all representations and warranties permissible under law.

Users not agreeing to this Policy or not wishing to be bound by this Policy shall not use the Website or the SOS Services in any manner.

Medikoe may amend, modify or remove the whole or any part of this Policy. No notice shall be provided by Medikoe prior to amending or modifying this Policy and Users shall be responsible to check for changes from time to time. The revised Policy shall become effective from the date on which it is published on the Website. Any User continuing to use the Website after the revisions have been effectuated shall be construed to have agreed to the revised Policy.

Any User wishing to contact Medikoe for any reason pertaining to the SOS Services may do so by writing to support@medikoe.com and Medikoe shall respond within 30 (Thirty) days.
